CORVA Annual Meeting and Elections, Saturday, May 15th 2010 at the California State University Bakersfield

The time is almost here, our Annual Meeting where we hold our elections and take care of business. This years meeting will be held again in Bakersfield, CA. We have 3 board positions open this year. As you might remember, we changed the bylaws a few years ago so that not all positions would be up at once. The positions up for election this year are; VP - Administration, VP - Education, and Treasurer . If you are interested in any of these positions please let me know.

The Annual meeting will take place on Saturday, May 15th 2010 at the California State University Bakersfield located at 9001 Stockdale Hwy Building 44B Room BDC 153, Bakersfield, CA 93311 (parking lot J) Elections for the Association Board (3) will take place at this meeting. Registration of members and clubs will begin at 9:30am followed by the Annual Meeting starting at 11:00am.

ADELANTO GRAND PRIX VOLUNTEER UPDATE

 WHAT: 30th annual Adelanto Grand Prix the largest GP in the world, hosted by the Desert Vipers MC. The most exciting 2 full days of racing featuring races from Pee Wees all the way to Pro Races attracting the fastest racers for Motorcycles, ATV's and Teams. Other favorite races include Classic and Vintage Motorcycles and even Side-hacks. Exciting action with races all day both days.

 WHEN: February 20-21, 2010

 WHERE: Adelanto Calif, located 80 miles from Los Angeles & Orange County in the high desert about a dozen miles north on HWY 395 from leaving Interstate 15.

 WHY: This is an important volunteer fund raiser effort in which CORVA will receive a $100 per each volunteer per day worked. We are looking for a dozen solid volunteers, to work for both days. The important spots on the course where we need to flag, need to be covered both days. This is intense and exciting action where the volunteer is up close an personal and needs to be alert at all times. No couch potatoes need apply. Looking for those who like speed, racing at its best and want an experience they won't forget.

Carnegie State Vehicular Recreation Area Update: On January 14th, the Court of Appeal, in San Francisco, filed an order accepting an amicus letter brief from the State Water Resources Control Board (SWRCB), filed on January 11, 2010. This letter argued that the Superior Court in Alameda County lacks jurisdiction to close the park because PEER and CSPA failed to exhaust their administrative remedies with the Water Board first before going to the Court.
Peer and CSPA have until January 20th to file an opposition to the SWRCB letter.
State Parks and/or the SWRCB have until January 25th to file a reply to the opposition from PEER and CSPA.
The park will remain open pending further court action. We expect the court to make a decision on the issue of park closure on or after January 26, 2010.

Starting today, the Quail Canyon facility is once again open to the public!

We have appreciated hearing your suggestions about the area - what you want changed, and how you want it operated. Thank you!

 The facility now features a motocross track, a vintage track, and a pee wee track! In addition, we have opened Quail Pass so visitors to the tracks will be able to access the rest of the park via Quail Pass and Pronghorn Trails. This also means that visitors can now access the Quail Canyon facilities from any of the campgrounds or day use areas within Hungry Valley State Vehicular Recreation Area.

 While some of you liked the design of the old track, many more of you asked that we gear the area to families and riders of all skill levels. As we move towards a more family oriented facility, the motocross track itself has been modified in an effort to better serve a broader variety of park visitors.

 The area is open Friday through Monday, from 8am to 5pm. (Hours are subject to change during the summer months). The entrance fee is now $5 and includes admission to the rest of the park. Since the Quail Canyon facility will be operated as part of Hungry Valley SVRA, applicable laws for spark arresters and sound limitations will be enforced. However, the Quail Canyon facility will continue to be operated as a closed course.

 Another exciting change –The Quail Canyon facilities are now also available for special events! Motorcycle Clubs, ATV and 4x4 enthusiasts, OHV Clubs, Non-Profits, Race Promoters, manufacturers, AMA, or private parties are just some of the examples of groups that will be able to “reserve” the track and facilities. This is a unique opportunity as the features and layout of the tracks can be changed to accommodate differing skill levels and various types of events such as motocross, grand prix events or hare scrambles.

 Thank you again for all of your positive suggestions and thoughtful input. We are excited by the changes and look forward to seeing you out at the track. Raid on OHV Funds Planned Again!
CORVA has received word that there will be another run on the OHV Trust Fund, this time aimed at the Grants Program that funds OHV recreation on federal lands. We all know that 80% of OHV recreation in California occurs on federal lands, most of it paid for with California OHV funds.

The CORVA Annual Meeting took place on Saturday, May 30th in Bakersfield, CA.  At the meeting we held our annual elections for officers of the Association.  We had the four offices of; President, Vice President-Land Resources & Public Policy, Vice President-Sales & Marketing, and Secretary open for nominations.  The four incumbents were seeking another term of office, this time a 2 year term as last year we staggered our Association board terms and each served only one year.

Help needed to change law to exclude youth-model motorcycles and ATVs  Change the Law to Exclude Youth-Model Motorcycles and ATVs! Take Action!
Write your Representatives Today!
The Consumer Product Safety Commission (CPSC) has voted to stay enforcement of the Consumer Product Safety Improvement Act of 2008 (CPSIA) that currently bans the sale of youth-model motorcycles and all-terrain vehicles (ATVs). The stay, which extends through May 1, 2011, follows a unanimous vote by Acting Chairman Nancy Nord and Commissioner Thomas Moore.
While we applaud the CPSC commissioners' vote to stay enforcement of the law, this does not solve the real issue, which is the law itself. Despite the stay, it is unclear whether state attorneys general will also decline to enforce the CPSIA. The sale of youth-model motorcycles and ATVs is still technically illegal. Even though a stay means that dealers would not be subject to fines or penalties imposed by the CPSC, state attorneys general would still be able to prosecute violators if they chose to do so. Youth-model motorcycles and ATVs should be exempt from the law, and Congress needs to act to make that happen.
Motorcyclists and ATV riders need to let Congress know that we are concerned about the law, and that we want youth-model OHVs excluded from the law. We need your help to let our lawmakers know how we feel. Riders should contact their Representatives and ask them to support H.R. 1587, introduced by Rep. Denny Rehberg, to exempt youth-sized motorcycles and ATVs from the CPSIA.

The Central Valley Regional Water Quality Control Board (CVRWQCB) voted unanimously yesterday evening to issue a Cleanup and Abatement Order (CAO) to El Dorado County and the Eldorado National Forest for the world-famous Rubicon Trail. Note that this is NOT an order for closure, as mentioned multiple times throughout the day by CVRWQB administrative staff, prosecution staff, and the Board Members. Lawsuit Announced to Stop Beach Driving From Killing Snowy Plovers in California's Oceano Dunes

 

OCEANO, Calif.— The Center for Biological Diversity Monday filed a formal notice of intent to sue against the California Department of Parks and Recreation over its ongoing authorization of motorized vehicle use at the Oceano Dunes State Vehicular Recreation Area, which is known to result in mortality of wintering snowy plovers—a threatened species.

Perris Raceway is under attack!!!
A single renter living a mobile home near the track has raised a fuss about the track, the dust and the noise. He has been harrassing the MX track management with calls to the police, fire department and Perris City Council.
The Perris City Council will be addressing these complaints at a meeting this Wednesday, March 4.
The track needs your support.
If at all possible, please come to this meeting at or before 6 PM.

Please tell the Governor’s to not  raid the OHV Trust Fund to help balance the state budget!

Good News. The calls hundreds of you made to your legislators urging them not to “borrow” $90 Million from your Green Sticker OHV Trust Fund made a difference!! Reliable sources tell us the Governor has offered to “borrow” only $60 Million, leaving us $30 Million. I bet you would rather not lose any of your $90 Million Green Sticker Fund.
In order to do that we need to keep the pressure on. So Save The Trails has a created an easy way. Legislative Alert  AB-134

CORVA just received notice of this new proposed legislation. This is another effort to legislate OHV safety for the young OHV rider and would impose a $125 fine on a guardian, parent or designated adult who allows a child under 14 to operate an OHV when they cannot safely reach the controls.

CORVA is presently analyzing the text of the legislation in order to fully understand all the potential implications of this bill. We have been aware that a new child ATV safety bill would probably be introduced by Assembly member Blakeslee following the failure of last year's bill.
Look for upcoming communications from CORVA on the legislative front.

Text of bill
(1) Existing law requires the operator of an off-highway motor vehicle to be able to reach and operate all controls necessary to safely operate the vehicle.

This bill would prohibit a parent or guardian of a child who is under 14 years of age, or an adult who is authorized by the parent or guardian to supervise that child, from granting permission to, or knowingly allowing, that child to operate an off-highway motor vehicle in a manner that violates the above-described requirement. By creating a new crime, the bill would impose a state-mandated local program. The bill would require a court, upon a 1st conviction, to impose a fine of $125. The bill would also impose fines upon a 2nd or subsequent conviction.

(2) Existing law requires the clerk of a court in which a person was convicted of a violation of the Vehicle Code to prepare within 5 days after conviction and immediately forward to the Department of Motor Vehicles an abstract of the record of the court covering the case in which the person was so convicted.

This bill would expand the Vehicle Code violations that the clerk of a court is required to report to the department to include violations of special regulations with respect to operating a vehicle on public lands, local ordinances prohibiting entry into mountain fire districts, proper supervision requirements for a child under 14 years of age operating an off-highway vehicle, and proper supervision requirements for a child under 14 years of age operating an all-terrain vehicle.

(3) Existing law establishes that specified convictions and violations under the Vehicle Code and traffic-related incidents count as points against a driver's record for purposes of the suspension or revocation of the privilege to drive and that certain other violations do not result in a violation point count.

This bill would expand the list of violations that do not result in a violation point count to include violations of special regulations with respect to operating a vehicle on public lands, local ordinances prohibiting entry into mountain fire districts, proper supervision requirements for a child under 14 years of age operating an off-highway vehicle, and proper supervision requirements for a child under 14 years of age operating an all-terrain vehicle.

(4) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.

Part of the Governor’s latest budget proposal is a $90M loan from the OHV Trust Fund to help balance the state budget!

Although we understand that the state is in the grip of the worst budget crisis in history, this loan is not a solution to the problem!

Why?  The law requires that this loan must be repaid within 2 years, so all this does is delay a real solution to the budget problem.

Similar tactics have been tried in the past.  In recent years the state budget was often balanced by borrowing billions from constitutionally protected trust funds reserved for highway construction and repair of local streets and roads.  Local governments united to oppose this borrowing gimmick and the governor and legislature agreed to stay away from borrowing from local government trust funds this year.  Unfortunately this commitment does not extend to our OHV Trust Fund.

The governor is proposing an urgency bill that would authorize this loan.  This money is our green sticker money that comes directly from the increased cost of green stickers from $25 to $50. This funding was supposed to go to law enforcement and other essential public safety services as well as improving our program. The public agreed to this fee increase to better fund the program, not to bail out the state budget.

What can you do?

 It is urgent that all OHV users get in touch with their state legislators as soon as possible.

Specific points to make are: 

  1.   Members of the public agreed to a fee increase to support a specific program, but now the revenue generated is being diverted from its intended purpose - a breach of public trust.  
  2.  Borrowing from state funds that must be repaid does not solve the budget problem, it only defers dealing with the problem to a later date when it will be even more difficult to solve.
  3.  Using a trust fund as a revenue source sets a bad precedent.  Trust funds are established to protect public funds for specific purposes. This could lead to diversion of funds from other trust funds in the future potentially including even entitlement funds.  
  4. The budget crisis must be resolved through a combination of spending cuts and tax increases, not more borrowing.

WHO WE ARE
The California Off-Road Vehicle Association (CORVA) is a varied group of outdoor recreationists who are extremely active in promoting the positive aspects of vehicular access on public lands and protecting that right. The group is composed of the owners of "Green Sticker" vehicles such as ATV's, motorcycles, 3-wheelers, trail bikes, and dune buggies, as well as "street legal" 4X4 vehicles, dual sport motorcycles, bajas, and desert racers.

CORVA's main purpose is to work with the land managers for responsible off-highway vehicular access and recreation opportunities. Secondarily, we educate our membership on the constantly changing rules and regulations and promote clean-up and trail maintenance projects. We continue to monitor and lobby the powers in Sacramento

The Omnibus Land Act of 2008 is a massive land grab bill that will lock up millions of additional acres of public land, close thousands of miles of recreation trails, harm already struggling rural economies, further reduce renewable resource harvesting, be detrimental to forest health by eliminating all forest management, restrict property rights and hamstring energy exploration in the United States.
If there were awards for bad legislation this bill might take first, second & third, but unless more people speak up it is likely to pass.
